Statutes Amendment (Fund Selection and Other Superannuation Matters) Bill

4 May 2021

The Hon John Darley made the following points in the Legislative Council on the Statutes Amendment (Fund Selection and Other Superannuation Matters) Bill.

John supported the Government’s Bill as it provided additional choice and portability for public sector employees. John noted that the Bill was supported by several large public sector unions and associations – the Public Service Association, Australian Nursing and Midwifery Federation, and Australian Education Union.

John was concerned that with any altered superannuation arrangements, Government should ensure advice is provided to all public sector employees so that individuals can make sound and informed decisions in their own best interests.

John Darley was also concerned that the status of the Triple S as a constitutionally protected fund (CPF), with significant tax benefits for members, be maintained and protected. It is understood that the Super SA Board sought and obtained legal advice that these amendments will not put the CPF at further jeopardy.

John Darley considered that it was incumbent on present and future State Governments, to keep this status and not trade it away, so that existing public sector employee benefits are kept.
